Talk Common vs. Civil Law: Much Ado About Nothing? November 17, 2017 / Cambridge, MA

IGLP is proud to co-sponsor a number of events, including lectures and workshops, organized by the RCC. On November 17th, 2017, José Manuel Martinez Sierra, Director of RCC, chaired a talk by Holger Spamann (HLS), who challenged some core aspects of the widespread distinction between Common and Civil Law, often representing the former as more business-friendly and efficient. Relying on World-Bank and hand-collected data, Prof. Spamann found, unlike earlier studies, that there are no systematic differences between common and civil law countries in the complexity, formalism, duration, or cost of procedure in courts of first instance. Given civil procedure’s central role for the common/civil law distinction, these findings challenge the distinction’s economic relevance.
