The Law and Politics of New Experimentalism

On May 22-23, 2017, IGLP co-sponsored “The Law and Politics of New Experimentalism”. The event, organized by Deval Desai (IGLP Fellow, Harvard Law School), Andrew Lang (IGLP Faculty, London School of Economics) and Pilar Domingo (ODI), convened a group of legal and social science scholars, development practitioners, and policymakers to discuss an emerging trend towards experimentalist policymaking in global governance and development.
Recent attempts to systematize an alternative approach to prescriptive policymaking have called for “politically sensitive”, “experimentalist”, “adaptive”, and “context-specific” reform – referred to collectively as “new experimentalism”. This workshop aimed to both deepen and broaden our understanding of these approaches. Broaden in the sense of drawing out the commonalities and differences between these different approaches, as well as place them in the broader context of the histories and lessons of similar approaches. Deepen in the sense of bringing to the fore the political and legal underpinnings of these approaches, particularly in ways they proceduralize change, as well as make law an object of change. Participants included IGLP Faculty Director David Kennedy, and IGLP faculty members Alvaro Santos (Georgetown University) and Rene Uruena (Universidad de Los Andes), and IGLP alum Amy Cohen (Ohio State University Moritz College of Law).
